CAD Details Licence Agreement

These Details are provided as an aid for use in preparing design documents for projects using Arxx Insulated Concrete Forms. It is the responsibility of the designer to ensure that all information required to suit local building codes and standards is included on the design drawings and specifications.

The Arxx design details are protected by a license agreement. By clicking "ACCEPT" at the bottom of this page, you will signify your acceptance of the terms of this agreement.

License Agreement

IMPORTANT – READ CAREFULLY

This License Agreement (the "Agreement") is a legal agreement between you (either an individual or a single entity) and Arxx Building Products Inc. for the Estimating Program software product provided to you (the "Software"). By installing, copying or otherwise using the Software, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Software and promptly return the Software to Arxx Building Products Inc. The Software is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. THE SOFTWARE IS LICENSED, NOT SOLD.

1. This Agreement grants to you the following rights:
   1. You may install and use one copy of the Software on a single computer. You may make copies of the Software for your exclusive use on a home computer and/or a portable computer.
   2. You may make backup copies of the Software as necessary.
2. Other rights and limitations are as follows:
   1. You may not reverse engineer, decompile, or disassemble the Software, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
   2. The Software is licensed as a single product. Its component parts may not be separated for use on more than one computer.
   3. You may not rent, lease or lend the Software to anyone.
   4. You may not modify or adapt the Software.
   5. You may permanently transfer all of your rights under this Agreement, provided you retain no copies, you transfer all of the Software (including all component parts, the media and printed materials and this Agreement) and the recipient agrees to the terms of this Agreement. You may not otherwise distribute the Software for any purpose.
   6. Without prejudice to any other rights, Arxx Building Products Inc. may terminate this Agreement if you fail to comply with the terms and conditions of this Agreement. In such event, you must destroy all copies of the Software and all of its component parts.
      
3. COPYRIGHT
   All title and copyright in and to the Software, the accompanying printed materials, and any copies of the Software are owned by Arxx Building Products Inc.
   
4. LIMITED WARRANTY
   Arxx Building Products Inc. provides the Software and accompanying materials solely on an "as is" basis and without any warranties.
   
   NO WARRANTIES
   
   TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARXX BUILDING PRODUCTS INC. DISCLAIMS ALL WARRANTIES AND CONDITIONS, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT WITH REGARD TO THE SOFTWARE.
   
   LIMITATION OF LIABILITY
   
   TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ARXX BUILDING PRODUCTS INC. BE LIABLE FOR ANY SPECIAL, INCIDENTAL, COLLATERAL OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING WITHOUT LIMITATION, DAMAGES OF LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF ARXX BUILDING PRODUCTS INC. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY CASE, ARXX BUILDING PRODUCTS INC.'S ENTIRE LIABILITY UNDER ANY PROVISION OF THIS AGREEMENT AND YOUR EXCLUSIVE REMEDY SHALL BE REPLACEMENT OF SOFTWARE. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
   
5. This Agreement is governed by the laws of the province of Ontario. You hereby irrevocably attorn to the jurisdiction of the courts of the province of Ontario and further agree to commence any litigation which may arise hereunder in the courts located in the judicial district of York, province of Ontario. This Agreement constitutes the entire agreement relating to the license of the Software.
